Is Probate Always Required?

By Barry Peters | Jun 29, 2019

Is probate always required when a person passes away?

No, probate is not always required.

If you have minimal possessions, probate may not be required.

How much is “minimal?” Well, if you own any real estate, probate will be required. Period.

If you don’t own any real estate, probate will still be required if you have possessions and accounts worth at least $100,000.

So, unless you own no real estate and have total assets worth less than $100,000, your family will be required to go through probate. Unless you take steps to avoid probate.

I had met with two other firms and they both were unsatisfactory regarding price and service. Marcus was a breath of fresh air on all aspects to being a great attorney!

It was a pleasure to work with Josiah. He answered every question we had and explained the entire process to us in simple terms that seniors can understand.
